Article 1 – Definitions

In these terms and conditions, the following definitions apply:
-Cooling-off period: the period during which the consumer may exercise the right of withdrawal;
-Consumer: a natural person who is not acting in the exercise of a profession or business and enters into a distance contract with the entrepreneur;
-Day: calendar day;
-Long-term transaction: a distance contract relating to a series of products for which the delivery obligation is spread over time;
-Durable medium: any tool that enables the consumer or entrepreneur to store information directed to them personally, in a way that allows future consultation and unchanged reproduction;
-Right of withdrawal: the consumer’s right to withdraw from the distance contract within the cooling-off period;
-Entrepreneur: the natural or legal person who offers products remotely to consumers;
-Distance contract: a contract concluded through a system organized by the entrepreneur for distance selling, using one or more means of distance communication;
-Means of distance communication: a method that can be used to conclude a contract without the consumer and entrepreneur being in the same place at the same time;
-Terms and Conditions: these general terms and conditions of Sorella Berlin.

Article 3 – Applicability

These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer.

Before concluding the distance contract, the text of these terms and conditions will be made available to the consumer. If this is not reasonably possible, the consumer will be informed where the terms can be accessed.

If the contract is concluded electronically, the terms may be provided electronically.

In the event of conflicting provisions between these general terms and specific product terms, the consumer may always rely on the most favorable applicable condition.

If any provision is found to be invalid, the remainder of the contract and these terms will remain in force.

Situations not covered by these terms shall be assessed in the spirit of these terms and conditions.

Any ambiguities in interpreting one or more provisions shall be interpreted in the spirit of these terms.

Article 4 – The Offer

If an offer has a limited validity period or is subject to conditions, this will be clearly stated.

The offer includes a complete and accurate description of the products. Images used are a true representation of the products offered.

Obvious errors or mistakes in the offer do not bind the entrepreneur.

The offer clearly outlines the rights and obligations involved in acceptance.

Artikel 1 – Begriffsbestimmungen

In diesen Bedingungen bedeutet:
- Widerrufsfrist: die Frist, innerhalb derer der Verbraucher sein Widerrufsrecht ausüben kann;
-Verbraucher: eine natürliche Person, die nicht im Rahmen ihrer gewerblichen oder selbstständigen Tätigkeit handelt und einen Fernabsatzvertrag mit dem Unternehmer abschließt;
-Tag: Kalendertag;
-Dauerschuldverhältnis: ein Fernabsatzvertrag über eine Reihe von Produkten mit zeitlich gestaffelter Lieferung;
-Dauerhafter Datenträger: jedes Mittel, das dem Verbraucher oder Unternehmer ermöglicht, an ihn persönlich gerichtete Informationen so zu speichern, dass sie in der Zukunft abgerufen und unverändert wiedergegeben werden können;
-Widerrufsrecht: das Recht des Verbrauchers, innerhalb der Widerrufsfrist vom Fernabsatzvertrag zurückzutreten;
-Unternehmer: die natürliche oder juristische Person, die Produkte im Fernabsatz an Verbraucher anbietet;
-Fernabsatzvertrag: ein Vertrag, bei dem ausschließlich Fernkommunikationsmittel genutzt werden;
-Fernkommunikationsmittel: ein Mittel, das zum Abschluss eines Vertrags verwendet werden kann, ohne dass sich Unternehmer und Verbraucher gleichzeitig am selben Ort befinden;
-AGB: diese Allgemeinen Geschäftsbedingungen von Sorella Berlin.

Artikel 3 – Anwendbarkeit

  • Diese AGB gelten für jedes Angebot des Unternehmers sowie für jeden über Fernkommunikation geschlossenen Vertrag mit einem Verbraucher.
  • Vor Vertragsabschluss wird dem Verbraucher der Text dieser AGB zur Verfügung gestellt.
  • Wird der Vertrag elektronisch geschlossen, kann der Text der AGB auch auf elektronischem Wege bereitgestellt werden.
  • Bei Widersprüchen zwischen diesen AGB und spezifischen Produktbedingungen gilt die für den Verbraucher günstigste Regelung.
  • Sollten einzelne Bestimmungen ungültig sein, bleibt der Vertrag im Übrigen wirksam.
  • Nicht geregelte Situationen werden im Sinne dieser AGB beurteilt.
  • Unklarheiten über die Auslegung der Bedingungen werden im Sinne dieser AGB interpretiert.

Artikel 4 – Das Angebot

  • Hat ein Angebot eine begrenzte Gültigkeit oder ist es an Bedingungen geknüpft, wird dies im Angebot angegeben.
  • Das Angebot enthält eine vollständige und genaue Beschreibung der Produkte. Bilder entsprechen der tatsächlichen Darstellung.
  • Offensichtliche Fehler im Angebot binden den Unternehmer nicht.
  • Das Angebot enthält alle relevanten Informationen zu Rechten und Pflichten des Verbrauchers im Falle der Annahme.
